2. The petitioner seeks bail in connection with Buniyadiganj P.S. Case No. 242/2024 registered for the offences under Sections 64, 294, 79 of the B.N.S. and Sections 66(E), 67, 67(A) of the I.T. Act, 2000.

3. The prosecution case in nutshell is that the petitioner had been sexually abusing the informant for the last two years. The informant has also alleged against the petitioner that he had forced her into physical relationship with him on the

Patna High Court CR. MISC. No.1560 of 2025(5) dt.09-05-2025 2/3 point of pistol and had also made videos and taken obscene photographs of the victim on his phone and had even posted them on the internet which later became viral and thereafter continuously exploited the informant sexually.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case as the informant herself is a married woman. Learned counsel further submits that due to some previous money dispute between the parties the present case has been lodged. It is lastly submitted that the petitioner has one criminal antecedent and is languishing in custody since 19.10.2024.

5. Learned counsel for the State as well as learned counsel for the informant have jointly opposed the prayer for bail of the petitioner. They jointly submit that petitioner made obscene videos of the informant and had even posted them on internet which later became viral.

Considering the aforesaid facts and circumstances of the case and taking into account that the petitioner had been continuously sexually abusing the informant for last two years and had even taken obscene pictures of her and then posted them on internet which later became viral, this Court is not inclined to grant privilege of regular bail to the petitioner.
