The petitioner seeks pre-arrest bail in connection with Bihta P.S. Case No. 717 of 2017, registered under Sections 341, 323, 324, 307, 504 and 34 of the Indian Penal Code. The accusation is that while in the evening of 18.09.2017, the informant, Nirmal Singh, was going to Bihta Market, in the way his brother, Bhagwan Singh (petitioner) and Akhilesh Singh, caught hold him and carried him to the eastern direction and tried to serve the liquor and on protest injuries were also caused on him through blade. On raising alarm the neighbour people rushed, then, all fled away from there. Submission is that the petitioner is the brother of the informant and due to family dispute, the informant lodged the
Patna High Court CR. MISC. No.82043 of 2019(3) dt.23-06-2020 2/2 present case. More over, three injuries, as found on the person of the informant, are simple in nature. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Bihta P.S. Case No. 717 of 2017 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, I, Danapur, Patna, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
