JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Keoti P.S. Case No. 171 of 2017, dated 24.10.2017, instituted for the offences under Sections 302/34 of the Indian Penal Code.

After some arguments, Mr. Md. Kamran, learned counsel for the petitioner seeks permission to withdraw this petition in order to enable the petitioner to surrender before the Court below and seek regular bail.

Patna High Court Cr.Misc. No.66628 of 2018(2) dt.17-12-2018 2/2 The petition is, accordingly, dismissed as withdrawn.

In case, such a petition is filed before the Court below within a period of six weeks from today, the Court below shall take into account that all other accused persons, similarly situated, have been granted regular bail, and, thereafter, shall pass orders in accordance with the law without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
