====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-02-2024 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 436, 504, 506/34 of the Indian Penal Code.

3. As per the prosecution case, petitioner No. 1 is alleged to have assaulted the informant on her shoulder. It is further alleged that all the accused persons set the house of the informant on fire.

4. Learned counsel for the petitioners submits that both parties are agnates and there is admitted land dispute between them due to which this false and concocted case has

Patna High Court CR. MISC. No.7920 of 2024(2) dt.20-02-2024 2/2 been lodged against the petitioners. It is further submitted that though there is allegation of assault against petitioner No. 1 but no injury report is available on the record. Petitioners claim clean antecedent.

5. Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Nawada (Nagar) P. S. Case No. 1072 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
