The petitioner apprehends his arrest in Motihari Mahila P.S. case No. 48/2019 registered under Section 341/323/307/498A/34 of the IPC.

The informant is the wife of petitioner. During the pendency of this anticipatory bail petition the learned counsel for the husband and the wife sat together with their clients. Mr. Bipin Bihari, the learned counsel for the petitioner, undertakes to pay Rs. 60,000/- per month for the maintenance of his wife and two children from the month of January, 2021. On such undertaking, the learned counsel for the informant submits that

Patna High Court CR. MISC. No.84419 of 2019(8) dt.29-01-2021 2/2 negotiations are afoot and there is every likelihood that the dispute may be resolved through negotiation. It is further submitted that since the petitioner is ready to pay Rs. 60,000/- per month to his wife and two children, the informant has got no objection if the petitioner is granted anticipatory bail. Taking into consideration the facts aforesaid and the fact that petitioner is ready to pay Rs. 60,000/- per month to his wife and two children from the month of January, 2021, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs.

10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Motihari Mahila P.S. case No. 48/ 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
