Petitioner, who is in custody, seeks bail in connection with Barh P.S. Case No. 221 of 2012 registered for the offences punishable under Sections 147, 148, 149 and 302 of the Indian Penal Code.

Informant who is the brother of the deceased has alleged that petitioner along with other co-accused killed his brother by firing upon him.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case only on suspicion. There is general and omnibus allegation against the petitioner. It has been further submitted that similarly placed co-accused has been

Patna High Court Cr.Misc. No.63001 of 2018(2) dt.26-10-2018 2/2 granted bail by another co-ordinate Bench of this Court in Cr. Misc. No. 14848 of 2014 vide order dated 31.07.2014. Petitioner has no criminal antecedent. He is in custody since 02.06.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Barh, District Patna in connection with Barh P.S. Case No. 221 of 2012.
