Mr. Ram Naresh Ray, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 11-12-2018 Heard learned counsel for petitioner no.3, namely, Md. Hasnain @ Hasnain and learned Additional Public Prosecutor for the State.

The petitioner seeks pre-arrest bail in connection with Sadar (Mufassil) P.S. Case No.295 of 2018 registered under Sections 341, 342, 323, 307, 379, 504 and 506/34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioners that co-accused Md. Salauddin @ Salauddin having more serious allegation than petitioner no.3, Md. Hasnain @ Hasnain has already been granted pre-arrest bail by a Bench of this Court vide order dated 22.11.2018 passed in Cr. Misc.

Patna High Court Cr.Misc. No.60254 of 2018(5) dt.11-12-2018 2/2 No.65453 of 2018.

Learned counsel for the State does not dispute the aforesaid contention advanced on behalf of petitioner no.3. Considering the submissions made above, in the event of arrest or surrender before the court below within six weeks from today, the petitioner no.3, namely, Md. Hasnain @ Hasnain is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Sadar (Mufassil) P.S. Case No.295 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
