The petitioner seeks bail in anticipation of his arrest in connection with Bhabua P.S. Case No. 554 of 2018 dated 31.07.2018 instituted for the offence under Sections 30(A) of Bihar Prohibition and Excise Act, 2016.

47.5 liters of liquor was recovered from the possession of Suraj Kumar Gond and Neeraj Kumar Gond. The aforesaid two persons have stated that the petitioner is their one of the associates.

Learned counsel appearing for the petitioner has submitted that nothing has been recovered from his possession and that in the past also he was falsely implicated by the police twice in cases of similar nature.

No.64130 of 2018(2) dt.14-12-2018 2/2 In fact the petitioner is a resident of a different ward but only because once he was made accused in this case, every time when somebody is arrested in an excise case, his name also is roped in. In the two cases in which he was earlier made accused, he is on bail.

Considering the aforesaid facts, the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VI-cum-Special Judge, Excise Act, Kaimur at Bhabua in connection with Bhabua P.S. Case No. 554 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. One of the sureties shall be a government servant.
