The petitioner seeks regular bail in connection with Harsidhi P.S. Case No.329 of 2018 registered for offences punishable under Sections 25(1-B)a. 26/ 35 of the Arms Act. Allegation against the petitioner is that there is recovery of country-made pistol and other arms from co-accused person. Petitioner is also named in the FIR.

Submission of the learned counsel for the petitioner is that there is no recovery from the possession of the petitioner and he is in custody since 11.08.2018.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be

No.61844 of 2018 (2) dt.12-10-2018 2/2 enlarged on bail on furnishing bail bond of Rs.25,000/-(Twenty Five thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Harsidhi P.S. Case No.329 of 2018, subject to condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
