The petitioner seeks bail in Mufassil Police Station Case No. 377 of 2018, registered for the offences punishable under Sections 304(B)/201/120(B) of the Indian Penal Code. The petitioner is the younger brother of the husband of the deceased.
Learned counsel appearing on behalf of the petitioner submits that there is general and omnibus allegation against almost all the family members, in the first information report. She also contends that there is no specific allegation against the petitioner of demand of dowry and the allegation of conspiracy is quite vague.
Upon going through the first information report, I find
Patna High Court Cr.Misc. No.61869 of 2018(2) dt.06-10-2018 2/2 substance in the submission so advanced on behalf of the petitioner.
This application is, accordingly, allowed.
Let the petitioner, Md. Nasim Mansuri, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each, to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari, in Mufassil P.S. Case No. 377 of 2018.
