ANJANA MISHRA ORAL ORDER 11-12-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor on behalf of the State. The petitioners are in custody since 18.11.2019, in connection with Complaint Case No. C-1 349 of 2019, CIS No. 349 of 2019 for the offences under Sections 30 (a) of the Bihar Prohibition & Excise Act, 2016.
Learned counsel for the petitioners submits that the alleged recoveries were not made from the conscious possession of the petitioners but from the vehicle and the petitioners are merely drivers of the concerned vehicle. It is further submitted that the petitioners have no criminal antecedent. Considering the aforementioned facts and
