Petitioner apprehends his arrest in a case registered for the offence punishable under Sections 341, 323, 324, 307, 325/34 of the Indian Penal Code.

Informant in his written complaint has alleged that on his ancestral land, FIR named accused Janardan Singh, Dilip Singh and Sandip Kumar were forcibly ploughing and when he asked them to stop they started abusing and assaulting him as result of which informant and his family members suffered grievous injuries. Allegation against Sandeep Kumar is of assaulting Sharda Devi by knife as a result of which she received cut injury on her hand.

It has been submitted on behalf of the petitioner that after investigation police did not found the case to be true

Patna High Court CR. MISC. No.83594 of 2019(2) dt.06-01-2020 2/2 against the petitioner and, submitted final form but differing with the police report the court below took cognizance against the petitioner. It has been further submitted that petitioner is a student and was not present on the alleged date of occurrence as such police found the case to be not true against him. Petitioner has got no criminal antecedent.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on anticipatory bail in the event of his/her arrest or surrender before the court below within a period of four weeks from today upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Suryapura P.S. Case No. 80 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
