Petitioners seek bail in Jamui P.S. Case No.60 of 2018 instituted for the offence under Section(s) 147, 148,149, 341, 323, 302 Indian Penal Code.
Counsel for the petitioners submits that mere
Patna High Court Cr.Misc. No.62529 of 2018 (2) dt.10-10-2018 2/2 suspicion has been raised against the petitioners. There is no eye witness to the occurrence. In the written report, it is alleged that altercation had taken place between the deceased and Mahabir Manjhi. Deceased had gone to sleep in the Basa where all the accused persons assaulted him by means to lathi, danda due to which he died.
Petitioners are in custody since 08.04.2018, 21.07.2018 and 09.02.2018 respectively.
Counsel for the petitioners submits that it is mentioned in para 3 of the bail petition that no blood stain was found at the place of occurrence.
In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui, in connection with Jamui P.S. Case No.60 of 2018, subject to the condition that both the bailors shall be close relative of the petitioners.
