JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-01-2020 This is an application for grant of anticipatory bail in connection with Bhagwanganj P. S. Case No. 31 of 2018, disclosing offences under Sections 366A/ 34 of IPC Allegation of kidnapping of minor daughter of the informant. It further appears that statement u/s 164 of Cr. P.C. of the victim girl that petitioner has also conspired in the above kidnapping.

Submission of the learned counsel for the petitioner is that no allegation of commission of rape and kidnapping against this petitioner, rather against one Karu and he has only been made accused on suspicion.

Heard learned A.P.P. also.

Having heard both sides, in view of the submissions, made above, I am not inclined to grant privilege of anticipatory

Patna High Court CR. MISC. No.83432 of 2019(2) dt.21-01-2020 2/2 bail to the petitioner. However, he has to surrender before the learned court below and make prayer for regular bail, the same shall be considered on its own merit, without being prejudiced by this order, and if, possible to be disposed of on the same day.
