The petitioner seeks bail in Kesariya P.S. Case No.289 of 2018 registered under Sections 307, 498A and other Sections of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act. The learned counsel for the petitioner submits that the petitioner is the husband of the daughter of the informant. The informant did not make any specific allegation of demand of dowry and torture. All the allegations are false and concocted. The daughter of the informant does not want to live conjugal life with the petitioner and that is why at her instance, her father lodged this case making false and frivolous allegation. The petitioner is in jail since 21.07.2018.
Patna High Court Cr.Misc. No.61725 of 2018 (2) dt.08-10-2018 Considering the facts aforesaid and the fact that the petitioner being the husband of the daughter of the informant has remained in jail for more than 2 1⁄2 months, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XI, Motihari, East Champaran in connection with Kesariya P.S. Case No.289 of 2018.
