JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2019 This application, for grant of anticipatory bail, arises out of Mednichowki P.S. Case No. 65 of 2019, disclosing offences under Sections 366(A), 504, 506 and 34 of the Indian Penal Code.

Prosecution case is that minor daughter of the informant was kidnapped and the informant suspects the hands of this petitioner and others, as the girl used to go to the house of petitioner.

Submission of learned counsel for the petitioner is that the girl has been recovered and her statement has been recorded, in which, she has made allegation against Rukmini Devi and she has further stated that she was forcibly married with another person and she express her desire to reside with her husband.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Lakhisarai, in connection with Mednichowki P.S. Case No. 65 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
