2. The petitioners apprehend arrest in a case registered under Sections 341, 323, 307, 379, 504 and 506/34 of the Indian Penal Code.

3. As per F.I.R., on the alleged date and time of occurrence, while informant was sitting at his door in the meantime, all the accused persons including these petitioners came and raised objection regarding planting of some flower plant to which informant stated that he has planted flowers in front of his door. On this all the accused persons started abusing and when informant protested then petitioner no. 2 assaulted on his head by iron rod and when son of informant came to rescue

Patna High Court CR. MISC. No.146 of 2025(2) dt.04-02-2025 2/2 then these two petitioners assaulted on his head by means of rod and stick as a result of which, he became unconscious.

4. Learned counsel appearing on behalf of the petitioners submits that due to land dispute between the parties, a scuffle took place in which both sides sustained injuries. Case and counter case. Injuries sustained by informant side are simple in nature. Petitioners have got clean antecedent.

5. Learned A.P.P. for the State opposed the prayer for bail of the petitioners.

6. Having considered the facts and circumstances of the case as well as the nature of injuries alleged caused by these petitioners, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Court No. 3, Judicial Magistrate-I, Muzaffarpur, in connection with Maniyari P.S. Case No. 140 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Singh, J) utkarsh/- U T
