Petitioner seeks bail in Shyampur Bhatahan P.S. Case No.10 of 2018, registered under Section 307 and other Sections of the Indian Penal Code.
The informant made allegation that the petitioner and his brother, Sri Bhagwan Kuar caught the informant and firstly asked him to withdraw the case. When the informant refused, the petitioner and his brother both put the informant on the ground and Sri Bhagwan Kuar is said to have assaulted the informant with iron rod on his head. The petitioner is alleged to have snatched Rs.2500/- from the pocket of the informant. The learned counsel for the petitioner submits that there is no allegation of assault against the petitioner. Patna High Court Cr.Misc. No.61664 of 2018(2) dt.08-10-2018 2/2 Bhagwan Kuar, the brother of the petitioner, who is alleged to have assaulted the informant with iron rod has already been granted bail vide order dated 25.07.2018 passed in Cr. Misc. No.44345 of 2018.
Considering the facts aforesaid, petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Sheohar in connection with Shyampur Bhatahan P.S. Case No.10 of 2018.
