This application for regular bail arises out of BodhGaya (Cherki) P.S. Case No. 693 of 2017 for the offences under Sections 147, 149, 341, 323, 448, 379, 307, 504, 506 and 302 of the Indian Penal Code.
There is specific allegation against petitioner No.1, Shivan Manjhi, of having assaulted the informant, who subsequently died. This application to the extent it relates to petitioner No.1 does not deserve to be allowed and is accordingly rejected.
However, learned counsel for the petitioners is correct in his submission that there is no specific allegation against petitioner No.2 nor there is any criminal antecedent in his
Patna High Court Cr.Misc. No.61906 of 2018(2) dt.06-10-2018 2/2 respect. He has also submitted that in similar circumstance other co-accused persons, namely, Shivdayal Manjhi and Neta Manjhi, have been allowed regular bail by this Court by order dated 06.09.2018 passed in Cr. Misc. No. 45151 of 2018. Considering the above submission, this application, to the extent it relates to petitioner No.2, namely, Angoor Manjhi, is allowed.
Let the petitioner No.2, namely, Angoor Manjhi, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in Bodh-Gaya (Cherki) P.S.
