The petitioner seeks bail in anticipation of his arrest in connection with Danapur P.S. Case No. 444 of 2018 dated 04.07.2018 instituted for the offences under Sections 420 and 34 of the Indian Penal Code, Sections 3, 4 and 11 of the Bengal Public Gambling Act, 1867. On information that a wagering game is being played with respect to T-20 match between India and England, a place was raided from where three persons were arrested. Those persons disclosed the name of the petitioner also for having associated himself with them in the aforesaid wagering.
Learned counsel appearing for the petitioner has submitted that the name of the petitioner has been
Patna High Court Cr.Misc. No.66755 of 2018(2) dt.18-12-2018 2/2 taken by the arrested co-accused persons and apart from this, there is no other material against him. Regard being had to the aforesaid facts as also taking into account that the petitioner does not have criminal antecedent, the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Danapur, Patna in connection with Danapur P.S. Case No. 444 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
