JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 Earlier the prayer for bail of the petitioner was dismissed vide order dated 12.07.2018 passed in Cr. Misc. No. 40361 of 2018 with direction to the trial Court to expedite and conclude the trial as soon as possible.

Submission of learned counsel for the petitioner is that instant anticipatory bail application has been filed on the ground that the other co-accused person having similar allegation has been enlarged on bail by a Coordinate Bench of this Court vide order dated 09.08.2018 passed in Cr. Misc. No. 43484 of 2018.

Heard learned APP also.

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner.

No.62933 of 2018(3) dt.20-12-2018 2/2 However, if the petitioner surrenders before the Court below within a period of six weeks and pray for regular bail, the court below after considering the submission of learned counsel for the petitioner as well as the merit of the case shall dispose of the prayer for bail of the petitioner.

With the above observation, this application is dismissed.
