The petitioners seek bail in a case registered for the offence under Sections 30(a) of the Bihar Excise and Prohibition Act.

Learned counsel appearing for the petitioners submits that the petitioners are innocent and have not committed any offence. Nothing has been recovered from the conscious possession of the petitioners and the petitioners have no concern with the alleged recovery. The petitioners are rotting in judicial custody since 28.10.2019. Considering the facts and circumstances of the

No.82543 of 2019(3) dt.06-03-2020 2/2 case, let the, above named, petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-3rd -cum- Special Judge, Excise, Kaimur at Bhabua in connection with Excise Case No. 798 of 2019 arising out of Durgawati P.S. Case No. 296 of 2019.
