2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 105 and 3(5) of the BNS 2023 .
3 . As per the prosecution case , informant alleged that on 17.08.2024 at about 04:15 PM, when the informant along with his grand-daughter went to meet the petitioner for getting
Patna High Court CR. MISC. No.766 of 2025(3) dt.15-04-2025 2/3 some exorcism done , the petitioner along with other co-accused persons took the grand-daughter of the informant in their lap and threw her on the floor, due to which the baby died.
4. It is submitted on behalf of the petitioners that petitioner is innocent and has committed no offence as alleged. Post Mortem report does not reveal any external injury and cause of death is said to be cardio respiratory failure due to conjunctive heart disease . There is general and omnibus allegation against this petitioner. There is counter version o the occurrence which was instituted by petitioner's side bearing Sursand PS Case No. 396 of 2024 . Moreover, Co-accused Binod Rai having similar and identical allegation has already been granted bail by Co-ordinate Bench of this Hon'ble Court vide order dated 15.02.2025 in Cr. Misc. No. 3365 of 2025 . Petitioner claims clean antecedent.
5 . Learned counsel for the State opposed the bail petition .
6 Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the
Patna High Court CR. MISC. No.766 of 2025(3) dt.15-04-2025 3/3 like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Pupri, Sitamarhi in connection with Sursand P.S. Case No. 388 of 2024 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
