The petitioner seeks regular bail in connection with Tajpur P.S. Case No. 281 of 2019 for the offence registered under Sections 30(a), 41(1) and 41(2) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of illicit liquor from a Bolero vehicle totaling to 354 litres from where coaccused person, namely, Ajeet Kumar was arrested by the Police and the petitioner was arrested on the basis of confessional statement of the said co-accused person Ajeet Kumar.

The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present

Patna High Court CR. MISC. No.83820 of 2019(2) dt.17-12-2019 2/2 case and he is languishing in custody since 14.11.2019. It is further submitted that the said co-accused person Ajeet Kumar who was apprehended from the spot, has already been granted bail by an order dated 16.11.2019 passed in Criminal Misc. No. 60842 of 2019.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Session Judge-II-cum-Special Judge, Excise, Samastipur in connection with Tajpur P.S. Case No. 281 of 2019.
