The petitioner seeks bail in connection with Hajipur Sadar P.S. Case No.243 of 2016/Sessions Trial No.191 of 2017 registered under Sections 147, 148, 149, 341, 323, 302 and 307 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that the prayer of the petitioner for grant of bail was rejected by this Court twice, lastly, on 28.03.2018 passed in Criminal Misc. No.49967 of 2017, with a direction to the learned Additional Sessions Judge-III, Vaishali, Hajipur, to conclude the trial of the petitioner within six months by taking all effective steps and if the trial of the petitioner is not
Patna High Court Cr.Misc. No.66103 of 2018(2) dt.02-01-2019 2/2 concluded within the aforesaid period of six months, the petitioner would be at liberty to renew his prayer for bail. Now, while more than the period of 10 months has already been elapsed, the trial of the petitioner has not been concluded as yet. The petitioner is in custody since 01.09.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-VI, Vaishali at Hajipur, in connection with Hajipur Sadar P.S. Case No.243 of 2016/Sessions Trial No.191 of 2017.
