1. Heard learned Counsel for the petitioner and learned APP for the State.
2. This application, for grant of anticipatory bail, arises out of Tatarpur P.S. Case No. 122 of 2024, disclosing offences punishable under Sections 452, 376, 506 of the Indian Penal Code and under Section 67(A) of I.T. Act and Sections 04, 08, 12 of POCSO Act.
3. As per the First Information Report, the informant was a student of S.K.P. Vidya Bihar, Bhagalpur and her parents were working as a teacher, so she lived alone in her house with her elder brother. During this period petitioner used to come to her house. On 14.10.2022 the petitioner came to the house of the informant, intoxicated her with cold drink and committed rape upon her and also took obscene pictures and videos of

No.415 of 2025(2) dt.06-02-2025 2/3 victim/informant and thereafter petitioner started threatening the informant and her family members and pressurized them to solemnize marriage with the informant and continued to commit rape upon her by blackmailing on the basis of obscene pictures and videos. It is further alleged that when the informant was admitted in Para Medical College in Supaul, the petitioner followed her and again started blackmailing her and made her fake ID on Instagram and sent objectionable videos to her relative.
4. Learned Counsel for the petitioner submits that there is delay of two years in lodging the FIR inasmuch as the occurrence is of 2022 whereas the FIR has been lodged in 2024. The petitioner has not committed any offence in the manner alleged and has falsely been implicated in this case with ulterior motive to compel him to marry the informant.
5. I have heard learned counsel for the parties and gone through the impugned order. It appears from the impugned order that the informant has supported the case in her statement recorded under Section 164 Cr.P.C. During course of investigation the witnesses have supported the case of the informant about the obscene pictures and photos posted on social media which were taken by the petitioner during course

6. Regard being had to the submissions made on behalf of the parties and taking into consideration the above facts, I am not inclined to exercise my discretion for grant of anticipatory bail.
