Petitioner seeks bail in Salkhua P.S. Case No.119 of 2018 instituted for the offence under Section(s) 364, 365/34 Indian Penal Code. Subsequently, section 302 Indian Penal Code was also added.

Counsel for the petitioner submits that petitioner is in custody since 30.05.2018 having clean antecedents. He is not named in the written report. As per written report, brother of the informant was last seen with Raj Kishore Yadav. The petitioner has been implicated merely on suspicion. It has come during investigation that deceased was having illicit relationship with one Ranju Devi and the deceased was in her house on the date of

Patna High Court Cr.Misc. No.66243 of 2018 (2) dt.06-11-2018 2/2 occurrence. Ranju Devi was examined by the police during investigation and she has named this petitioner. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa, in connection with Salkhua P.S. Case No.119 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
