JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Bhagwanpur P.S. Case No. 58 of 2018 dated 10.04.2018 instituted for the offences under Sections 341, 323, 324, 307, 379, 34 of the Indian Penal Code.
The petitioner and four others are alleged to have made attempts at snatching the motorcycle of the informant. The learned counsel for the petitioner has submitted that in fact, because of rash driving by the informant, one boy of the locality was injured. When a protest was made by the local villagers including the petitioner, the informant ran away and in order to save his
Patna High Court Cr.Misc. No.69007 of 2018(2) dt.18-12-2018 2/2 skin, the present F.I.R has been lodged.
Regard being had to the aforesaid background of the case and the petitioner being a person of clean antecedents, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 58 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
