2. The petitioner is apprehending his/her arrest in connection with A.P.M. P.S. Case No. 152 of 2025, dated 30.09.2025 registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022.
3. As per the prosecution case, the informant along with other police personals were on patrolling and in course of vehicle checking, they saw that two persons were coming on a motorcycle from Horalpatti Road and seeing the police, both the persons left motorcycle and started running away. Both the persons were chased by the police, but one person was caught by the police and one person manage to escape. After interrogation arrested person
Patna High Court CR. MISC. No.87724 of 2025(2) dt.19-12-2025 2/3 disclosed his named as Amit Kumar Sahni and also tell the name of the person, who ran away as Ramdas Sahni. After search of motorcycle 40 liters of Chulai liquor has been recovered. After that seizure list was prepared.
4. Learned counsel for the petitioner submits that the recovery is said to have been made from the Motorcycle, which does not belong to the petitioner and petitioner has clean antecedent. The name of the petitioner has transpired on the basis of confessional statement of co-accused namely Amit Kumar Sahni, who was taken to judicial custody.
5. Learned APP for the State opposes the prayer for anticipatory bail application.
6. Regard being had to the submission made by the parties, taking into consideration the fact that illicit liquor has not been recovered from the constructive possession and/or premises belonging to the petitioner and petitioner has clean antecedent, accordingly, this Court is inclined to grant anticipatory bail to the petitioner.
7. Let the petitioner, above named, be released on anticipatory bail in the event of his/her arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge-1 (Excise Act), Darbhanga in connection with A.P.M. P.S. Case No.
