JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 The petitioner seeks regular bail in connection with Madhubani Town P.S. Case No. 308 of 2018, registered for offences punishable under Sections 420, 467, 468, 471 and 34 of the Indian Penal Code.

Allegation as per F.I.R. is that the Circle Officer on information that the company of the petitioner is collecting applications after taking Rs.1,000/- for distribution of loan, raided the office of the petitioner and demanded the papers, on which petitioner could not produce the registration certificate and they were collecting papers for Pradhanmantri Mudra Loan Yojana and petitioner is said to be the Cashier of the company Jan Jyoti Seva Sansthan.

Submission of learned counsel for the petitioner is

No.69245 of 2018(3) dt.20-12-2018 2/3 that the NGO of the petitioner is tied-up with SEDA, which is a registered organization of the West Bengal Government for collecting the papers and submitting them to the Magma Company Ltd. and as such he was collecting the applications and has falsely been implicated in this case and the petitioner is in judicial custody since 31.08.2018. Further submission is that other co-accused persons have already been granted bail by a Coordinate Bench of this Court vide order dated 04.12.2018 passed in Cr. Misc. No. 68931 of 2018.

Heard learned A.P.P. also, who opposed the prayer for bail of the petitioner stating that the petitioner is the Chairman of the company and cheated the people.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhubani, in connection with Madhubani Town P.S. Case No. 308 of 2018 with condition that he has to cooperate in disposal of the trial otherwise his bail bonds shall be cancelled. (Vinod Kumar Sinha, J) Amjad/- U T
