====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-04-2025 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. Petitioner seeks regular bail who is in custody since 18.10.2024 in connection with Pakaridyal P.S. Case No. 312 of 2019, FIR dated 03.10.2019, registered for the offences punishable under Section 394 of the Indian Penal Code.

3. The prosecution case, as per the allegation in the First Information Report is that four persons riding on two motorcycles intercepted the informant and looted a sum of Rs. 2,20,000/- from him.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case on the basis of confessional statement of co-accused Chhotan Sahni who has been granted bail by this Court vide order dated 03.11.2020,

Patna High Court CR. MISC. No.3082 of 2025(4) dt.04-04-2025 2/2 passed in Criminal Misc. No. 24431 of 2020. He further submits that petitioner has not committed any offence in the manner alleged and he is in custody since 18.10.2024. He next submits that the other co-accused persons, namely, Munnar Kumar and Rajendra Sahani have also been granted bail by this Court in Criminal Misc. No. 22867 of 2020 and 25111 of 2020 respectively.

5. Having regard to the submissions made by the parties and materials on record and the fact that petitioner is in custody since 18.10.2024 and similarly situated co-accused person has been granted bail by this Court, I am inclined to grant regular bail to the petitioner.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court of A.C.J.M.-8, East Champaran, Motihari, in connection with Pakaridyal Police Station Case No. 312 of 2019.
