JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in connection with Belaganj P.S. Case no. 318 of 2018, registered under Section 304(B)/34 of the Indian Penal Code.
The accusation is of killing of the daughter of informant by her husband and other in-laws due to nonfulfillment of demand of dowry. Learned counsel for the petitioner submits that after the marriage, the daughter of the informant along with her husband Raushan Sharma used to reside separate and due to quarrel in between daughter of the informant with her husband Raushan Sharma, she committed suicide, but with ulterior motive, whole family members have falsely been implicated in
Patna High Court CR. MISC. No.81463 of 2019(3) dt.18-06-2020 2/2 this case. Further submission is that Raushan Sharma, husband of deceased, is in custody since 09.07.2019. Further submission is that Kanti Devi and Chandra Shekhar Mistri @ Chandr Shekhar Sharma, mother-in-law and father-in-law of the deceased has already been allowed privilege of pre-arrest bail by this Court vide Criminal Miscellaneous No. 50886 of 2019 on 16.08.2019. The petitioner happens to be the brother in law of the deceased and he has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.
10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate-XI, Gaya in connection with Belaganj P.S. Case No. 318 of 2018 (G.R. No. 7283 of 2018), subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
