The petitioner is apprehending arrest in connection with Buxar Nagar P.S. Case No.205 of 2018 for offences under Sections 147, 148, 307, 427, 120(B) of the Indian Penal Code and Sections 25(1-b)a, 25(i) A, 26, 27 and 35 of the Arnms Act. .

Counsel for the petitioner submits that the instant case has been lodged by the police in relation to demolition of house and boundary of Nathuni Yadav. He submits that earlier Nathuni Yadav had lodged FIR, Annexure-2 wherein he has not named the petitioner as accused. The name of the petitioner figured in this case as his JCB machine was seen by the police party at the place of occurrence.

No.71163 of 2018(2) dt.17-12-2018 2/2 Considering the fact fact that the petitioner was not named in the earlier case lodged by Nathuni Yadav and in this case there is no overt act alleged against him causing injury attracting Section 307 IPC and different Sections of the Arms Act, the court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in connection with Buxar Nagar P.S. Case No.205 of 2018, subject to the conditions as laid down under Section 438(2) Cr. P. C.
