Petitioner seeks bail in Dumra P.S. Case No. 128 of 2018 registered for the offence punishable under Sections 399, 402, 413 and 414 of the Indian Penal Code and under Section 25(1-b)a, 26 and 35 of the Arms Act.
Informant who is a police officer has filed a written complaint that on secret information received that some criminals have assembled to commit dacoity then he along with other police personnel reached said place and on seeing the police party six criminals tried to flee away but they were chased and apprehended, however four managed to flee away. Petitioner is also one of the apprehended accused from whose possession one loaded country made pistol has been recovered. Petitioner is in custody since 01.04.2018 and Similarly, situated co-accused person namely Sardar Jha has been granted
Patna High Court Cr.Misc. No.76083 of 2018(2) dt.19-12-2018 2/2 bail vide order dated 03.10.2018 passed in Criminal Miscellaneous No. 50998 of 2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Dumra P.S. Case No. 128 of 2018, with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the court below.
(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner. (S. Kumar, J) ranjan/- U
