The petitioner seeks regular bail in connection with Kako P.S.Case No.298 of 2018 registered for offences punishable under Sections 307, 326/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the FIR, there is allegation against the petitioner and other accused persons that they entered inside the house of the informant and the petitioner and one Gautam Kumar fired causing injury to the injured and the gun powder on his face. Submission of the learned counsel for the petitioner is that even according to the FIR, the shot fired by the petitioner does not hit anybody and the injury was caused by firing by other accused person and in this case final form was submitted

Patna High Court CR. MISC. No.82481 of 2019(2) dt.12-12-2019 2/2 against him finding the case not true but the cognizance has been taken by the learned Magistrate. He is in custody for more than one month.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Jehanabad or his successor court, if any in connection with Kako P.S.Case No.298 of 2018.

With the above direction, this application is allowed.
