The petitioner is seeking anticipatory bail in connection with Alamnagar P.S. Case No. 221/2019 registered under Sections 341, 323, 384, 504, 506 of the Indian Penal Code and 27 of the Arms Act.
Learned counsel for the petitioner submits that the informant is the father of the petitioner and the dispute is with regard to the share of ancestral land. Learned counsel submits that informant is in habit of filing such cases and in fact he had lodged one case against the younger son with whom he entered into a settlement after the younger son undertakes to pay a sum of Rs. 6000/-towards maintenance. Petitioner has no criminal antecedent.
Learned A.P.P. for the State has opposed the prayer for
Patna High Court CR. MISC. No.85281 of 2019(2) dt.09-01-2020 2/3 anticipatory bail of the petitioner.
Considering the facts and circumstances of the case wherein it is the submission of learned counsel for the petitioner that the informant is none else than the father of this petitioner who has made all the false and frivolous allegations because of the property disputes as the petitioner was objecting to the informant when he was selling the ancestral land and further submission that the informant is in habit of filing such cases and in fact he had lodged one case against the younger son also with whom he entered into a settlement after the younger son undertakes to pay a sum of Rs. 6000/-towards maintenance of the parents, in the nature of disputes, this court directs that in case of his arrest/surrender before the court below within a period of four weeks, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs.
15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of C.J.M., Madhepura, in connection with Alamnagar P.S. Case No. 221/2019, subject to condition as laid down under Section 438(2) of the Cr.P.C. i.e.

No.85281 of 2019(2) dt.09-01-2020 3/3 (ii) a condition that the person shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;
