The petitioner seeks bail in Alamnagar P.S. Case No. 205 of 2018 instituted for the offence under Sections 379 and 411 of the Indian Penal Code.

Counsel for the petitioner submits that there is no recovery from possession of petitioner by the police personnel. The alleged seizure has been made by the informant and produced before the police which is apparent from the production cum seizure list. Seizure list is part of the First Information Report.

The informant has alleged that in the night his Mobile phone and purse containing Rs.70,000/- went missing. The informant during search learnt that petitioner has stolen the

Patna High Court Cr.Misc. No.77220 of 2018(2) dt.21-12-2018 2/2 same. The informant went to sasural of petitioner and recovered seven mobiles from his possession. There is no recovery of money from him. The said Mobile Phones have been produced by the informant before the police. Thereafter, police prepared production cum seizure list.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief judicial Magistrate, Udakishunganj, Madhepura, in connection with Alamnagar P.S. Case No. 205 of 2018 subject to the condition that both the bailors will be the close relatives of the petitioner.
