2. The instant writ application has been filed for the

2/4 following relief(s):- "(i) That this is an application for issuance of writ in the nature of mandamus order or orders, direction or directions commanding the respondent nos. 1 and 2 to conclude and dispose of the Encroachment Appeal No. RM-39 of 2023 24 as has been filed by respondent nos. 12 and 13 against the order dated 15.07.2023 passed by the respondent no. 5 and further direction may be given to respondent no. 5 to remove encroachment made by the respondent nos. 8 to 11 as revenue employee has submitted false report that encroachment made by respondent nos. 8 to 11 have been removed whereas the said encroachment has not been removed as yet pursuant to the order passed by the respondent no. 5 in Encroachment Case No. 16 of 2019-20 and further appropriate direction may be given to that effect."

3. The petitioner is directed to file a fresh

3/4 representation within a period of four weeks from today with regard to the encroachment, in question, giving full details of the persons who have made construction over the land and creating obstruction over the public road by blocking the same. The petitioner is also permitted to give details of all such properties which, according to him, is a public land and is under encroachment by the encroachers and on finding the statement to be true in reference to the revenue record, appropriate action shall be taken by issuing notices to the concerned encroachers.

It is expected that once such an application for removal of the encroachment is filed by the petitioner, then the Circle Officer, Majhaulia, West Champaran will initiate the appropriate proceeding under Section 3 of the Bihar Public Land Encroachment Act, 1956 and, after giving notice to all concerned, necessary orders shall be passed, adjudicating the issues, in question, and once it is found that the land, in question, is a public land and the same has been encroached by the private persons, the same shall be made encroachment free within the period of three months.

5. It is expected that the entire exercise shall be carried out and concluded within the time frame of eight weeks from the date of initiation of proceeding under Section 3 of the

4/4 Bihar Public Land Encroachment Act, 1956.

6. With the aforesaid observation and direction, the writ petition stands disposed of.
