2. The petitioners seek bail in a case registered for the offence punishable under section 80 of the Bharatiya Nyaya Sanhita, 2023 .
3 . As per the prosecution case , informant's sister was married with co-accused Avinash Kumar in the year 2023 . After sometime , petitioners and their family members started subjecting the victim to cruelty and harassment. On 12.1.2025 informant's sister tried to commit suicide by hanging. Thereafter, she was taken to hospital where she died during treatment on 13.1.2025 .
4. Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.87224 of 2025(2) dt.27-01-2026 2/2 petitioners are innocent and have falsely been implicated in this case. There is general and omnibus allegation against the petitioners and no specific overt act has been alleged against them who happen to be father-in -law and mother-in -law of the deceased. It is further submitted that the petitioners are separate in mess and business. Thrust of allegation is against the husband of the deceased who has surrendered on 3.7.2025 . Petitioners are in custody since 09.10.2025 .
5. Learned counsel for the State and the informant oppose the prayer for bail.
6. Considering the aforesaid facts, period of custody and other circumstances of the case , the bail application is allowed . Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 1st Additional Chief Judicial Magistrate (ACJM) Patna in connection with Gopalpur Police Station Case No. 39 of 2025 .
