BAJANTHRI) 10-07-2025 The present MJC No. 4581 of 2024 / contempt application is not maintainable on the ground of delay in filing the contempt application. The Co-ordinate Bench while passing order on 02.08.2021 in CWJC No. 12622 of 2021 directed the petitioner to approach the District Magistrate, Samstipur within a period of four weeks from 02.08.2021. The petitioner representation is dated 07.08.2021. Thereafter, the concerned authority was required to pass reasoned and speaking order within a period of three months which lapse on 06.11.2021. The cause of action accrued to the petitioner on 05.11.2022, whereas the present contempt application is filed in the year 2024. In the light of these facts and circumstances, the present MJC No. 4581 of 2024 is barred by limitation.

In this regard, the Co-ordinate Bench in the case of Dr. Rajesh Kumar Sinha and others vs. The Union of India and Others in MJC No. 1840 of 2023 dated 24.07.2023, elaborately considered Section 20 of the Contempt of Courts Act read with Article 215 of the Constitution. Principles decided in the aforementioned decision aptly applicable to the case in hand. Accordingly, the present contempt petition stands

Patna High Court MJC No.4581 of 2024(3) dt.10-07-2025 3/3 dismissed on the ground of delay and laches reserving liberty to the petitioner to file fresh writ petition.
