====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-03-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Petitioner seeks regular bail in connection with Mufassil P. S. Case No. 599/2019 in a case registered for the offences punishable under Sections 307, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, co-accused Manisha Jaiswal and her husband Ranjit Jaiswal called brother of informant on the pretext of returning his money and got him shot by other accused persons.
4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. His name transpired during
Patna High Court CR. MISC. No.2027 of 2025(2) dt.05-03-2025 2/2 course of investigation on confessional statement of co-accused Rakesh Kumar wherein he has stated that this petitioner was present at the time of the alleged occurrence and that he ordered to shoot at the brother of informant. Petitioner is in custody since 20.10.2024. Charge-sheet has already been submitted.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, East Champaran, Motihari in connection with Mufassil P. S. Case No. 599 of 2019.
