JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2019 This application, for grant of anticipatory bail, arises out of Phulwari Sharif P.S. Case No. 914 of 2019, disclosing offences under Sections 461 and 379 of the Indian Penal Code. Allegation is of commission of theft of battery from the ATM booth and in the CCTV footage, motorcycle of the petitioner was found parked at the place of occurrence. Submission of learned counsel for the petitioner is that he runs a confectionery business and he has hired several persons for delivery of items and they used the motorcycle of the petitioner. Petitioner has no criminal antecedent and he has falsely been implicate in this case.

Having heard both sides, considering the submission,

Patna High Court CR. MISC. No.83884 of 2019(2) dt.18-12-2019 2/2 as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Judge -IX-cum-ACJM, Patna, in connection with Phulwari Sharif P.S. Case No. 914 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
