JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 25-04-2018 Heard learned counsel for the petitioner and the counsel appearing on behalf of the Vigilance. Petitioner is apprehending arrest in connection with Vigilance P.S. Case No. 106 of 2016 for the offence under sections 420, 109, 467, 468, 471, 472, 477(A), 409 and 120(B) of the Indian Penal Code read with Section 13(2) of the Prevention of Corruption Act, 1988.

From perusal of the FIR, it appears that case was registered in connection with mis-use of the fund allocated by the State Government for distribution among the teaching and non-teaching staff of the College. The alleged cheque was issued on 26.12.2014 whereas this petitioner has joined as Incharge Registrar only on 22.5.2015 and he remained on the post as Incharge Registrar up to 8.12.2015 and the alleged

Patna High Court Cr.Misc. No.25145 of 2018(2) dt.25-04-2018 2/2 irregularity has been committed prior to joining of the petitioner as In-charge Registrar.

Considering the aforesaid and the fact that similarly circumstanced, others have been granted anticipatory bail by this court in Cr. Misc. No. 25768 of 2017, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Vigilance, North Bihar, Muzaffarpur, in connection with Vigilance P.S.
