The petitioner is languishing in custody for the offences punishable under Sections 272/273/420/34 of the Indian Penal Code and Sections 30(a)/38 of the Bihar Prohibition and Excise Act, 2016.

Name of the petitioner surfaced in the confessional statement of co-accused. There is no allegation of any recovery from the possession of the petitioner nor the petitioner was put on Test Identification Parade. The petitioner has got three identical criminal cases.

Considering the criminal antecedent of the petitioner, let the petitioner, above named, be released on bail after framing of the charge on furnishing bail bond of Rs.20,000/-

Patna High Court CR. MISC. No.86018 of 2019(2) dt.14-01-2020 2/2 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Barauni (F.C.I.) P.S. Case No.416 of 2017, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the Court.

The trial Court is directed to expedite framing of the charge.
