JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner apprehends her arrest in connection with Lalganj P.S. Case No.315 of 2019 registered under Sections 304(B)/34 of the Indian Penal Code.

The accusation is of killing the daughter along with the granddaughter of the informant by her husband and other in-laws due to non-fulfillment of the dowry demand and also disposing of their dead bodies.

Learned counsel for the petitioner submits that, admittedly, the petitioner is the mother-in-law of the daughter of the informant. Dinesh Pandey, the husband of the daughter of the informant, used to reside outside the State and the daughter of the informant used to put pressure upon her husband to go to her service

Patna High Court CR. MISC. No.81640 of 2019(3) dt.19-06-2020 2/2 place but he was not ready and due to anger, she committed suicide along with her daughter. In presence of the informant, the dead bodies of his daughter and granddaughter were disposed of but the informant with an ulterior motive lodged the present case. Further submission is that after realizing the real fact, the informant has filed an application to compromise the case on 13.11.2019 before the court below. The petitioner, who is lady, has no criminal antecedent. More so, Dinesh Pandey alias Dinesh Kumar Pandey, the husband of the daughter of the informant, has already been granted the privilege of pre-arrest bail by this Court vide order dated 09.01.2020 passed in Criminal Misc. No.83132 of 2019.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender by her within six weeks from today, be enlarged on bail on her furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XIV, Vaishali at Hajipur, in connection with Lalganj P.S. Case No.315 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
