The petitioner seeks regular bail in connection with Bettiah Muffasil (Banuchhapara O.P.) P.S.Case No.5 of 2019 registered for offences punishable under Sections 457 and 380 of the Indian Penal Code.

Prosecution case is of theft of 15 silver coins and cash of Rs.10,000/- from the house of the informant.

Submission of the learned counsel for the petitioner is that he is not named in the FIR. Apart from that there is nothing against the petitioner. He is in custody for more than seven months. Charge sheet has already been submitted as such there is no chance of tampering with the evidence. Heard learned A.P.P. also.

No.85569 of 2019(2) dt.13-01-2020 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bettiah, West Champaran in connection with Bettiah Muffasil (Banuchhapar O.P. ) P.S.Case No.5 of 2019.

With the above direction, this application is allowed.
