2. The petitioner apprehends arrest in connection with Dehri Town P.S. Case No. 399 of 2025 registered for offences under Sections 30(a) of the Bihar Prohibition and Excise Act.

3. There is recovery of 25 liters of illicit liquor from the Toto (E-Rickshaw).

4. Learned counsel for the petitioner submits that the petitioner was the registered owner of the ToTo vehicle in question and the petitioner has already sold the aforesaid vehicle to one Lakhichand Sah S/o late Sarju Sah R/o Karpurwa, P.S. Sasaram, Rohtas on 20.02.2025.

5. Learned APP for the State has vehemently opposed the prayer of the petitioner.

6. Considering the facts and circumstances of the case and the submission of learned counsel for the petitioner, this application for anticipatory bail stands allowed.

7. Accordingly, let the petitioner, above-named, in the event of arrest or surrender within four weeks from today in the Court below, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court below in connection with Dehri Town P.S. Case No. 399 of 2025 subject to the conditions as laid down under Section 482(2) of the BNSS.

8. The Superintendent of Police, Rohtas is directed to get the case investigated and if he finds that Lakhichand Sah S/o late Sarju Sah R/o Karpurwa had purchased the said vehicle in question, he will proceed against him in accordance with law. (Sandeep Kumar, J) Shishir/- U T
