JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2019 This application, for grant of anticipatory bail, arises out of Govindganj P.S. Case No. 176 of 2019, disclosing offences under Sections 341, 323, 427, 327, 379 and 504/34 of the Indian Penal Code.
Allegation against the petitioners is of assault to the informant and on threatening, they took the signature of the informant on stamp paper.
Submission of learned counsel for the petitioners is that the F.I.R itself disclosed that there is land dispute between he parties and cases are going on between them. Further
Patna High Court CR. MISC. No.83856 of 2019(2) dt.18-12-2019 2/2 submission is that a Title suit has been decided in favour of the petitioners and out of annoyance this false case has been lodged. Moreover, no specific allegation has been attributed to the petitioners.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-I, Motihari, in connection with Govindganj P.S. Case No. 176 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
