Petitioners are apprehending arrest in connection with Chanpatia (Sirisiya O.P.) P.S. Case No. 238 of 2019 for the offence under sections 341, 323, 504, 379, 354, 506/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioners have no criminal antecedent.

Patna High Court CR. MISC. No.5249 of 2020(6) dt.29-06-2020 2/2 Learned counsel submits that the allegation on the face value is ornamental and there is no serious allegation of any serious assault.

Petitioner No.1 has earlier lodged case against the family members of the informant bearing Chanpatia (Sirisiya O.P.) P.S. Case No. 237 of 2019.

Considering the fact that petitioners have no criminal antecedent, the Court is inclined to grant anticipatory bail to the petitioners, let the petitioners, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Chanpatia (Sirisiya O.P.) P.S. Case No. 238 of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C. with further condition both the bailors should be villagers. (Anil Kumar Upadhyay, J) Ravi/- U T
