The petitioners filed this petition to restore Cr. Misc. No. 31297 of 2016, which stood dismissed for non compliance of peremptory order dated 10.11.2016.

The learned counsel for the petitioners was directed to convert Cr. Misc. No. 31297 of 2016 into Cr. Appeal under Section 14A of the SC/ST Act in view of division bench judgment of this court passed in Cr. Misc. No. 25276 of 2016 but due to non compliance of the order the aforesaid Cr. Misc. stands dismissed but the petitioners have got remedy to file fresh appeal against the order impugned rejecting their prayer for anticipatory bail. Since the petitioners have got remedy to file fresh appeal for grant of anticipatory bail, I am not inclined to restore Cr. Misc. No. 31297 of 2016 to its original file. Accordingly, this Cr. Misc. petition is dismissed.
